But not the judge, and when the prosecutor slipped it during closing arguments in he was admonished. Carol Leonnig and Amy Goldstein in Juror Is Dismissed From Libby Trial:
Libby, 56, is charged with making false statements, perjury and obstructing a probe into who may have criminally leaked information about undercover CIA officer Valerie Plame to the media in 2003.
Leonnig and Goldstein seem to know what Judge Walton says he does not--whether Plame was "undercover." Patrick Fitzgerald gave up trying to prove it.
If Leonnig and Goldstein have some new information they should email him with the details or maybe even write a story about it.
Update: NRO Media Blog's Stephen Spruiell notes the most interesting item in last Sunday's Deborah Howell column: A friend-of-the-court brief (pdf) signed by Victoria Toensing and news organizations including the Washington Post arguing against forcing Matt Cooper and Judy Miller to reveal sources because it had not been shown that Plame was covert. It still hasn't been--not by Fitzpatrick, not by the CIA, not by any public proceeding other than the conventional non-wisdom repeated by reporters whose internet connections are at least as good as mine.
